You are a mental health professional who receive a subpoena to submit your client’s records and testify in an upcoming court proceeding. Alternatively, a client ask you to testify on their behalf in an upcoming criminal trial. This workshop will prepare you for responding to each of these situations, balancing the needs, rights, and wishes of your client with your legal and ethical obligations to the court and the system of justice.

This workshop addresses legal and ethical issues faced by mental health background from various contexts of practice. It addresses ethical issues such as confidentiality, fidelity to clients, honest and integrity, and conflicting roles and interests. This workshop may be of particular interest to people who practice in mental health, child welfare, criminal justice, juvenile justice, family law, or other legal contexts of practice. This workshop also addresses malpractice lawsuits, which may be a risk for any mental health professional.

This workshop will empower participants to engage in informed and collaborative discussions with clients and attorneys to determine the best approaches to responding to a subpoena or a request for participation in a court proceeding. Participants will also be encouraged to problem-solve with clients and attorneys by discussing options, ensuring all voices are heard, and working toward consensus.

Objectives include:

1. identify whether a document that they receive is an enforceable subpoena requiring them to submit their records and/or testify in court.
2. Engage in informed discussions with clients about how they would like them to respond to a subpoena.
3. Make informed choices, with the assistance of an attorney, about ethical and effective responses to a subpoena or a request to testify

    Allan Barsky, JD, MSW, PhD is a professor with Florida Atlantic University’s Sandler School of Social Work. His book credits include Ethics and Values in Social Work, Clinicians in Court, Essential Ethics for Social Work Practice, Conflict Resolution for the Helping Professions, and Interprofessional Practice with Diverse Populations. Dr. Barsky was awarded the “FAU Scholar of the Year Award” in 2020 and “FAU Alumni Association Impact in Teaching Award” in 2024. Dr. Barsky chaired the National Association of Social Workers National Ethics Committee, as well as the Code of Ethics Review Committee.
