Implementing Workplace Protections for Pregnant or Lactating Personnel

The Pregnant Workers Fairness (PWFA) and Providing Urgent Maternal Protections (PUMP) Acts were signed into law by President Biden on December 29, 2022. PWFA requires covered employers to provide reasonable accommodations for an employee’s known limitations correlated with pregnancy, childbirth, or related medical conditions, unless doing so will cause the employer an undue hardship; while the PUMP Act expands workplace protections for lactating employees and requires employers to provide reasonable break time and private space for personnel to express milk while at work. On August 7, 2023, the Equal Employment Opportunity Commission issued its Notice of Proposed Rulemaking for implementing the PWFA’s protections for pregnant workers, and the resulting Rules were published on April 19.
